1. Marketplace Overview

Northern Plains Artisan Collective LLC (“NPAC,” “we,” “us”) operates an ethical digital marketplace connecting buyers with independent Native American artisans across the Northern Plains (North Dakota, South Dakota, Minnesota, and Montana). By accessing or purchasing from our platform, you agree to these Terms of Service.

2. Artisan Status & Provenance (25 U.S.C. § 305e)

All creators on this marketplace are independent third-party artisans. In strict compliance with the federal Indian Arts and Crafts Act of 1990 (25 U.S.C. § 305e), all items marketed as Native American or Indian-made are produced by enrolled citizens of federally or state-recognized tribal nations or certified Indian artisans. Sensitive tribal enrollment identification is verified and securely vaulted by NPAC.

3. Cultural Integrity Policy

In accordance with community standards and tribal traditions, NPAC strictly prohibits the commercial sale of sacred, ceremonial, or restricted regalia. Our catalog is dedicated entirely to living, secular traditional craftsmanship and contemporary arts.

4. Pricing & Artisan Remittance

We operate on an artisan-first economic model where 90% of net item sales proceeds return directly to the creator. Retail prices are established collaboratively with each artisan.

5. Made-to-Order & Custom Work

Certain items (such as custom starquilts) are handmade to order. By placing an order for a custom piece, you acknowledge and accept the stated production lead time (typically 3 to 5 weeks) prior to carrier shipment.

6. Intellectual Property

All cultural designs, patterns, motifs, and creative works remain the 100% exclusive intellectual property of the individual artisan. Neither NPAC nor buyers acquire any copyright or licensing rights in the designs.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of North Dakota.
